| 摘 要：许多医学工作者认为，医学学术不端行为仅包括抄袭、重复发表、一稿多投、造假等情况，即传统的医学学术不端行为，而将一些可能是学术不端行为(可能是违法或侵权行为)误认为是正当行为，如毕业论文的再发表，进修医生在进修阶段写作的文章发表等。全文通过对具体行为及法理学的分析，并指出对具体的情况如何处理，希望能够指导作者，避免学术不端行为的发生。 |

| Abstract：Many researchers bear in mind that academic misconduct only including plagiarizing，secondary publications，multiple submission，academic cheating and other misbehavior. Some writers might considered some special kinds of academic misconduct as reasonable action，e.g. to publish the graduate paper on a certain medical journal，intern doctors from other hospitals write articles using the clinical data from the practical hospital. Based on the events above，this article analyzed these misbehaviors from the legal points of Copyright Law，and the methods to deal with all the problems，in order to avoid academic misconduct. |
